South Nyack, NY residents are finally discovering how the proposed new Tappan Zee Bridge Several will affect them. It looks as if several South Nyack homes could be commandeered by the state if the new Tappan Zee Bridge project adheres to the current plan.

According to the recently released Draft Environmental Impact Statement (DEIS)— in the proposed blueprint for building the new spa six South Nyack homes could be eliminated. If that actually happens the owners will be relocated and reimbursed.

 

The report mentions the following properties:

 

·         21 Cornelison Avenue (Two-family home)

·         78 Smith Avenue

·         306 South Broadway

·         317 South Broadway

·         319 South Broadway

·         321 South Broadway

 

Also mentioned is a garage structure and green space on Smith Avenue, with another parcel her on South Broadway. Some other nearby properties could also have easements placed on them, meaning the state would temporarily take control during construction, but later return them. Again, residents would be compensated, but by how much is another question yet to be answered.

All told six acres of South Nyack land will be lost at a cost to the state of approximately $4.4 million, according to state officials.

The DEIS describes the acquisitions as a situation where, "[a] parcel is transferred to the New York State Thruway right-of-way, pursuant to applicable state and federal regulations, thereby dissolving its private ownership and potentially requiring relocation of the existing land use."

The hard part to swallow for the property owners involved is that should this plan go forward, state officials would value the properties and compensate at   "the fair market value of the property.” It couldn’t come at a worse time as property values in the area are at the lowest levels seen for many years.

Residents who do not agree on the amount offered may file a claim with the New York State Court of Claims. To be successful, they will need to be armed with some comprehensive background information as to their argument. To that end, I would like to offer a free CMA (current market analysis,) and monthly market snapshot providing statistics of homes currently on the market. This will provide a comprehensive report of properties that have sold recently, list vs. sold prices etc. This should start as soon as possible in order to track the values as months go-by until the owners receive an offer from the state. This will enable owners to be fully aware of what they should expect to receive and how adversely their value has been affected by the project.
